PLAZA – Responding to demands that it do something to prevent a reoccurrence of Halloween’s near-riot, and potential harm to people and property, the City and Arcata Police mounted a major anti-mayhem effort on the Plaza New Year’s Eve.

That afternoon, Parks Division workers installed a flexible plastic fence around the entire center of the Plaza. The plastic palisade both demarked the off-limits zone and, by its flimsiness, deprived anyone so tempted of anything substantial to use as a missile or cudgel.

As the witching hour approached, the flimsy fence had become a novelty attraction it is own right.

Opinions were mixed on the fence’s efficacy and appropriateness. “I’m not opposed to this,” said Arcata High student Rebecca Smith, who had served as faux vice mayor of Arcata during the recent Student Government Day exercise. She said that after reviewing the damage toll of close to $10,000 on Halloween, preventive measures were prudent. Still, she advocated creation of other events throughout downtown as an alternative and solution to downtown destruction. “I think that’s a very good idea,” Smith said.

Others saw the fence as an attractive nuisance, or a challenge for determined partiers to surmount. “I think this is probably going to make people rebel more,” said Faviana Schectman. “This could create more potential anger,” agreed Zoe Tinseth.

By nightfall, that symbolic barrier had been augmented by swarms of police officers from neighboring agencies – Eureka Police, Ferndale Police, Fortuna Police, Humboldt County District Attorney’s Office, Humboldt State University Police and Rio Dell Police.

As the evening progressed, the Plaza was all but devoid of non-police officers. Most citizens skirted the square entirely, evidently assuming by the massive police presence that it was on “lockdown,” as one passerby was heard to mention.

Police did little to disabuse anyone of this assumption. Officers milled about not just in the fenced-off Plaza center, but on all the corners. As a crowd massed at Ninth and H streets, a small phalanx of officers formed a reverse delta formation at the planter, creating a disincentive to pass beyond the outer sidewalk. While crowd behavior can lead to a breakdown of personal standards by those involved, as evidently occurred on Halloween, this night the crowd effect worked to police advantage. Those among the roiling mass of celebrants chose to stick with the crowd, few breaking away for solo expeditions. Lacking an alpha to lead the charge beyond the outer sidewalks, the crowd remained off the Plaza altogether. The police’s psychological tactic worked, deterring all but a few approaches to the gossamer barrier surrounding at the Plaza’s core.

The bluff was reminiscent of how an APD officer told 4/20 attendees last spring that the event had been “canceled” due to rain, which was impossible since it had never been formally scheduled by anyone. Then as now, the misdirection was effective. Rarely were there more than a dozen individuals on the main Plaza at any given time.

Police Chief Tom Chapman coordinated the massive multi-agency response from a cordoned-off complex of  APD vehicles located in the 600 block of Eighth Street on the Plaza’s southeast corner.

One support vehicle was used as a processing center for arrestees, while another trailer housed a small canteen for officers.

From within the new Incident Response Vehicle, APD brass monitored the action, or lack thereof, via a mast-mounted video camera looking down on the square. Chapman and Lt. Bart Silvers were able to zoom in on hot spots such as Ninth and H streets and redeploy officers as necessary.

That became necessary when a man was dragged from a percussion circle on the corner of Ninth and H, halting the rhythmic exercise. He resisted arrest and was subdued by a half-dozen or more officers. The spectacle entranced the crowd and, as it surged beyond the corner planters to watch and point cell phones at the cop-on-drunk action, it briefly threatened to break through the imaginary barrier that was holding celebrants off the Plaza.

But police quickly carried the arrestee off, excitement died down and by 12:30 a.m. or so, the Plaza was no burlier than on any other weekend night. Virtually all of the action was concentrated along Tavern Row.

Police subdue an individual resisting arrest, to the fascination of the Ninth and H crowd. But that was the extent of the big excitement that night, and once he was carted off, it wasn't long before the crowd dissipated.

At 2:20 a.m. on New Year’s morning, Chapman issued a press release declaring the preventive measures a success. The release stated that during the course of the evening six arrests were made, plus five arrests for public intoxication and one arrest for driving under the influence.

What it cost

Chief Chapman said that APD rang up roughly $2,800 in overtime costs for APD officers on New Year’s Eve and New Year’s Day morning. There were other miscellaneous other costs too trivial to tally, such gas for the power generator at the mini-APD station. Food for officers was donated by local businesses.

Providing highly effective role modeling for fellow New Year's Eve carousers, Jeff Musgrave and Chakeeta chose to make love, not mayhem.

Chapman said that as a matter of policy, the number of officers deployed on the Plaza won’t be disclosed. However, ground observations that night easily places that number in the dozens, as APD was prepared for any eventuality.

Other police agencies which assisted that night did not bill the City for the mutual aid, and were paid by their respective jurisdictions. “They’re taking care of their own,” he said. Chapman ballparked the other agencies collective costs at about $2,500.

About that $30,000

Ever since the news of Halloween-related damage came out, an inaccurate figure of $30,000 has been bandied about for Plaza cleanup and repair costs. It persists despite the accurate numbers having been repeatedly published, with attribution to City officials.

The actual Halloween fixup figure is about $3,600, covering Plaza rehab the next day, according to Parks Supt. Dan Diemer. Another estimated $5,000 in damage was done to the Plaza’s irrigation system. that will be fully ascertained when the system is fired up this spring.

So where did the highly inflated $30,000 in Plaza damage number come from? Chapman takes responsibility for it, with qualifiers.

He said that in talking to Times-Standard reporter Jessica Cejnar the day after Halloween, he guesstimated the total cost of the previous evening’s mass derangement at $30,000 – with all costs included, City and civilian. These, Chapman said, include jail booking fees, broken windows and other property damage, emergency room visits, DA’s Office prosecutions, court time, Arcata Fire medical aid calls, ambulances and all other resources, public and private, required to address the All Hallow’s Eve aftermath.

Chapman’s ballpark estimate was accurately reported in the T-S, but some erroneously assume that it applies only to City of Arcata costs associated with the Plaza.

“I can’t fault the reporter, as I speak too freely sometimes and shouldn’t,” Chapman said. “I was speaking in the broader context and have to take responsibility.”

But, he added, “I still don’t necessarily disagree with the number,” insofar as it applies to the totality of costs from the Halloween debacle.

PLAZA – Simply Macintosh employee Solomon Clark was selling a MacBook Pro and iPad to a customer this morning when the man suddenly thought different – but only about the paying-for-it part.

Clark said the customer had settled on the two items, and he was about to show him accessories when things took an unexpected turn.

“He was holding both, which seemed kind of weird, when I went to show him where the cases were,” Clark said. “I turned around and he was on his way out the door.”

Clark and fellow employee Hank Ketelsen gave chase as the man headed south, crossing Eighth Street to the area of the Arcata Post Office. Slowed in his escape by the boxes of Apple products he was toting, the fleeing suspect couldn’t outpace his pursuers.

When Clark and Ketelsen caught up with him, the suspect said, “Yo man, back off. I’m gonna shoot you with pepper spray,” Clark recalled.

At that point, a mail delivery vehicle drove up and Clark yelled, “He’s stealing stuff!” The postal employee then positioned the mail truck to block the suspect’s escape, but he eluded the blockage and  then ran a down the alley behind the Post Office to the area of Seventh and I streets.

There, the fleeing thief was blocked again, by a citizen driving another truck. The citizen got out and confronted the suspect, who again threatened use of pepper spray. “He told the guy, ‘Back off, I’ll spray you!’ and the guy said, ‘I don’t care,’” Ketelsen recalled.

The suspect apparently tried to spritz the citizen with the pepper spray, but Ketelsen said there was a misfire of some sort. “Nothing came out,” he said.

As Clark, Ketelsen and the citizen struggled to restrain the man for police, another passerby who apparently thought the three were mugging someone came over to assist the suspect. “He didn’t know what we were doing and didn’t want to see someone hassled,” Ketelsen said.

But at that point, the suspect’s blonde wig, sunglasses and gray beanie fell off, and his ruse collapsed along with any well-intentioned passerby intervention. “You’re wearing a wig. I’m not going to help you,” the citizen said, according to Ketelsen.

Police arrived within a minute or so, Ketelsen said, and arrested Skylar Austin Moser, 22, of Arcata. All of the stolen property was recovered.

Moser was transported to the Humboldt County Correctional Facility where he was booked on charges of robbery, possession of tear gas over 2.5 ounces and use of a tear gas other than for self defense.

ARCATA – The Arcata Police Department (APD) will conduct a sobriety/drivers license checkpoint on Saturday, Nov. 12 in the downtown area of Arcata.

Impaired driving has been identified as one of the greatest threats to public safety. Statistics show that every day, almost 30 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This amounts to one death every 48 minutes. The annual cost of alcohol-related crashes in the U.S. totals more than $51 billion.

In 2009, 10,839 people were killed in alcohol-impaired driving crashes, accounting for nearly one-third (32%) of all traffic-related deaths in the United States.

Through proactive efforts such as sobriety check points, the APD hopes to reduce the impact of impaired drivers on the citizens of Arcata.

CALIFORNIA AVENUE – For months, all manner of signs and banners from throughout Arcata – particularly Northtown – as well as the Humboldt State campus, have been disappearing from their installed locations and, as it turns out, migrating toward a house on lower California Avenue.

Residing at the house are Jordan Richard “JK” Keeling, from Milpitas, and Robert Andrew Espinoza, from Los Angeles, both 20-year-old Humboldt State students.

Weekend before last, they had a big party, bedazzling attendees with walls plastered with pilfered placards. And banners.

And road signs. And door numbers. Even restaurant fixtures. And other odds and ends, including a stolen football helmet.

Virtually any type of semi-permanent or better sign that could be pried from its moorings or simply plopped in a pocket was proudly presented at the party.

One of the more elaborate signs – arguably the centerpiece – was a $1,500 job torn from the upper wall of Big Pete’s pizzeria in Northtown.

“They must have climbed up on the roof to get it,” said Big Pete’s owner Pete Ciotti, of whoever took the sign. “They had to break the holder and slide it out.”

When it disappeared in April, Ciotti reported the theft to Arcata Police. It wasn’t until the weekend wingding, though, that the vanished pizza sign was spotted in the wild – at the house occupied by Keeling and Espinoza.

The hosts weren’t just oblivious to the simple statistical likelihood of someone connected to one of the many small-town businesses whose signs adorned the walls being in the crowd, they openly boasted of the thefts to people they didn’t know, according to Ciotti.

“They were all, ‘Yeah, we steal signs, me and my homey. That’s what we do,’” he said. Degrees of separation in a small town being what they are, a friend of Ciotti’s at the party listened to the reckless braggadocio, took a cell phone picture of the filched furnishings and then passed it along.

Monday, Arcata Police were in the loop. Early Tuesday morning, Oct. 4, they were in Keeling and Espinoza’s house.

Officers located nearly 50 suspected stolen signs and other text-bearing items inside the residence. Recovered signs appear to be the property of local businesses, schools, state, federal and local governments. Additional suspected stolen property in the residence included road pylons, gas station price numbers and an orange-painted newspaper rack.

Keeling and Espinoza were arrested and booked into the Humboldt County Correctional Facility on suspicion of possession of stolen property.

Police haven’t documented which items are stolen and which may have been obtained legally. Some could have been retrieved from dumpsters during remodeling projects, though others are warped at their mounting points, as though they were forcibly wrenched free without use of tools.

Possession of the Big Pete’s sign alone pushes the matter past the $400 threshold and into the felony zone.

Keeling and Espinoza’s house was one place in our polarized world where small local businesses and corporate giants dwelled in harmony.

Fast-food powerhouses McDonald’s, Burger King, Subway, KFC and Jack In The Box compete for visual attention with signs from Arcata’s own Morning Star clothing boutique  and Arcata Pizza & Deli. That business was represented by a small, plastic stand-up sign from one of its tables advertising its hours and phone number.

The collection, while eclectic,  seems conceptually ambivalent, even amorphous and suggestive of random opportunity, if not some sort of persistent compulsion or maybe just simple kleptomania.

Now resting in the APD evidence locker, next to small mountains of cannabis grow equipment from other pending cases, are multiple road signs warning of hazards like detours, an open trench and loose gravel in unknown locations. For some reason, there were five copies of a sign directing traffic around an unknown boulevard.

Others specify locations. One green sign is from L.K. Wood Court. A brown one is from Mad River County Park, and offers directions to parking and restrooms.

The mix includes a few door signs. One is from the Green & Gold Room in HSU’s Founders Hall. Another iconic public restroom sign was found, appropriately enough, on the suspects’ bathroom door, according to APD Det. Sgt. Todd Dokweiler. Other signs seem way out of place. In a town full of bicyclists, signs warning of open trenches and loose gravel might have been more useful in their original locations. Another warns to keep out of an unknown archery range.

Three large plastic numbers of the type used in backlit gas station price signs were present, spelling out “420.” Even a few decidedly non-stoney HSU parking lot banners found their way into the collection. Other banners tout the sort of dining fare – Burger King and KFC – that might appeal to young men on the go.

A few of the signs were modified with edgy witticisms. A “STOP” sign had been augmented with marking pen to read “CAN’T STOP.” A “SPEED 15” sign was altered to read “SPEED YES PLEASE 15 HITS.” A Denny’s flyer affixed to a handheld stop sign had read, “America’s diner is always open,” but was changed to read, “JK’s diner is always open.”

Also among the items confiscated were table umbrellas emblazoned with Coca-Cola logos and a Humboldt State Lumberjacks football helmet. HSU spokesman Paul Mann said the helmet was reported stolen during the big Sept. 8 game televised on CBS.

“The whole house was littered with these signs,” Dokweiler said. The collection even spilled out onto the front porch, he said, with other pieces “scattered about.”

Dokweiler guessed that the Northtown emphasis is because that neighborhood is located at the mid-point between downtown and the suspects’ residence off L.K. Wood Boulevard. He theorized that the two may have paused to add to their collection while walking home from Plaza night spots.

Besides the physical evidence, APD is basing its case on statements they say the suspects made to officers when the search warrant was served Tuesday morning. Dokweiler said the two immediately admitted to taking the signs, and with startling openness.

“If I woke up with cops in my bedroom, I wouldn’t be bragging about stealing things,” he said. That night, after a stretch in the Pink House, Keeling posted a three-word status update on his Facebook page: “straight compton wakeup.”

Ciotti said he was glad to be getting his stolen sign back, but that he wasn’t sure what he was going to do with it now that it has been replaced and the Northtown shop’s color scheme changed. He guessed he might use it inside or at the Eureka Big Pete’s.

Dokweiler said that in addition to the charges of possession of stolen property, grand theft charges could also be filed if police obtain evidence that the two committed the actual thefts.

Along with any criminal  penalties, Keeling and Espinoza could face discipline, including suspension from school, under Humboldt State’s Student Conduct Code.

Among listed punishable offenses are “theft of property or services from the University community, or misappropriation of University resources,” “unauthorized destruction, or damage to University property or other property in the University community,” and “any act chargeable as a violation of a federal, state, or local law that poses a substantial threat to the safety or well being of members of the University community, to property within the University community or poses a significant threat of disruption or interference with University operations.”

Penalties could include disciplinary probation, which allows continued class attendance; suspension from Humboldt State; suspension from the entire California State University system; or permanent expulsion. Community service could also be part of the punishment.

Mann confirmed that some of the signs are the property of Humboldt State. UPD Chief Lynne Soderberg is checking with campus Plant Operations to determine when the signs were stolen. She said any punishment the lads might undergo would be confidential under the Family Educational Rights and Privacy Act (FERPA). All the university could disclose is whether or not someone is a student at the university.

Neither Keeling nor Espinoza responded to Facebook messages seeking information.  Wednesday, following issuance of an Arcata Police press release and news stories in local media, Keeling’s Facebook page disappeared altogether, followed by Espinoza’s on Thursday.

Keeling isn’t done with social media, though, leaving his Twitter page public. On Thursday, Oct. 6, he posted, “too famous for facebook. hello again twitter.”

While the suspected sign swipage, subsequent publicity and Facebook sign-off appear to have offered a pivotal life lesson in cause and effect for a young man, Keeling’s Twitter feed documents what may be a previous brush with indulgence and insalubrious consequence.

An exuberant Sept. 26 tweet reads, “fuck bitches, get money, eat pizza. repeat as necessary.”

Four days later, a more resigned-sounding update states, “Here we go again (@ Student Health Center).”

The new playset.

ARCATA – Arcata Police have arrested two juvenile suspects and are seeking a third in the Sept. 3 arson which destroyed the playground at Chevret-Vaissade Park.

Through a lengthy investigation by APD, three juvenile suspects were identified. Two of the suspects, a 12-year-old from Arcata and a 13-year-old from Pittsburg, Calif., have been arrested. The third juvenile suspect, a 14-year-old from Fortuna, is still at large.

Update: On Wednesday, Sept. 28, the third juvenile suspect, a 14 -year-old from Fortuna, was arrested for his alleged part in the fire. This third and final arrest completes the investigation. 

APD detectives learned that the three juveniles allegedly used cardboard, small branches and a piece of wood to ignite a fire on the playground structure. Once ignited, the juveniles rolled the burning piece of wood next toa vertical piece of the play structure which also ignited.

Police Chief Tom Chapman said that the Pittsburg youth was originally from Arcata. He and the others had been visiting a fourth juvenile who lives in the area and was uninvolved in the arson incident.

Chapman said the 13-year-old had had previous law enforcement contact for arson and theft offenses in Arcata.

An APD press release said that community support in re-establishing the playground as well as apprehending the responsible parties has been” tremendous,” and that investigators received “numerous” leads from community members throughout the investigation.

As is often the case, loose talk led police to the suspects. “Word spread from their peer group and somebody came forward to say, ‘These guys are bragging about being involved.’” Chapman said.

The APD press release said that there is nothing to connect these juveniles to any other suspicious fire in the City of Arcata.

While numerous donations have been received to offset the $10,000 deductible and assist with purchase of a replacement playset, Chapman said the juveniles’ parents and/or guardians may also have to help pay as well. “This is the classic situation where the families will be held financially responsible,” he said.

New playset on order

The Arcata City Council approved the purchase of a replacement play structure for Chevret-Vaissade Park at a special meeting Monday, Sept. 19. The equipment was ordered about three hours after the meeting’s end and is expected to be delivered by Friday, Oct. 14.

According to City Parks Superintendent Dan Diemer, installation will begin immediately after the play ground equipment is received from Landscape Structures, Inc. of Delano, Minnesota. Construction will be completed, weather permitting, within three weeks.

“The playground will need to be reconstructed immediately,” said Diemer about the approaching wet weather. “The site is not suited to construction during the rainy season.”

To date, the City has accepted several donations from community members, neighboring residents, businesses and non-profit organizations. The donations are expected to cover a large portion of the $10,000.00 deductable from the City’s insurance policy. The City Council will formally accept the donations at the Wednesday, October 5, City Council meeting.

Mayor Susan Ornelas said, “The City is just so thankful and proud for the citizens who stood up and recognized the need to make this playground right again as soon as possible.  Its citizens like these that make Arcata great!  I want to invite everyone in Arcata to the opening or the new Chevret-Vaissade Park – we will keep people updated as to when the ribbon cutting will be.”

Caught on video is an Arcata City water department employee driving up to a home in his Arcata city truck, wearing his reflector vest, yellow baseball cap that dons the City of Arcata logo, holding a hand-held computer, and in his other hand he has a semi-automatic handgun aimed in the face of a half-naked 70-year-old man visiting his brother.

Seems the City of Arcata sanctions the use of its water department to help out the Arcata Police Department stamp out the marijuana madness. It turns out the water department employee in the video was an imposter; he was an Arcata Police officer instead. But someone at City Hall sanctioned the use of the uniform, water meter accoutrements and a City truck with the Arcata oval logo on its doors.

This is troubling and dangerous for everyone involved, save the police. I spoke to some law enforcement friends of mine who say that the use of a “friendly city employee” going to the front door before the guns and badges are flashed makes it safer for the police officers who are about to enter a home with a search warrant.

Perhaps it does. But does the subterfuge make it safer for the real water department employee when he or she comes out to read a meter or check a leak?

When I see city workers at my house, I talk to them and ask how they are doing. City workers are part of the monthly scenery at home, city workers other than cops. Until now I had thought that the water department employee was just that, not a cop in water department’s clothing. You are not going to get me to trust another city worker again unless I see identification. I don’t want to guess whether the City is sending out a water department employee or a police officer dressed as a water department employee.

I have nothing to hide at my house, except my privacy, yet I still don’t want anyone walking around my property with a gun, be it a cop or a robber, unless the cop is there to stop the robber. I don’t mind talking to a cop, in fact I enjoy it most of the time, but I want to know he or she is a cop.

I feel for the Arcata city employee too. When he or she goes out to a resident’s home, the reception will be, and should be, with suspicion. Residents will have to ask for identification to know if the person on the property is there to check the water flow or snooping around for police business.

You and I may be suspicious of the city worker and reluctant to be friendly with the would-be fraudster, but what about the real criminals, how will the criminals treat a water department employee when they turn a corner and see City worker on their property?

The City of Arcata has done a terrible disservice to their civilian employees essentially stripping them of their aura of friendliness and innocence. No one likes an imposter. The City worker will be suspected as an imposter, suffer the specter of deceit and lose the kindness of homeowners.

VALLEY WEST – In response to numerous neighbor complaints, Arcata Police Department officers served a search warrant on a suspected illegal marijuana cultivation operation in Valley West last Wednesday, Aug. 24.

The warrant was served on a double wide mobile home at 1122 Cedar Drive in the Valley West Mobile Estates park. Inside, officers discovered a sophisticated indoor marijuana cultivation operation that utilized the entire domicile.

No one lived there, and there was no evidence that the home was used for any purpose other than marijuana cultivation.

“This one was a little different,” said Det. Sgt. Todd Dokweiler. “It was not set up for living. There was no place to sleep, nothing like that.”

Officers seized about 40 pounds of dried marijuana in various stages of processing and  nearly 500 growing marijuana plants along with a large amount of cultivation equipment.

No one was at the residence at the time the warrant was served and no arrests were made.

“It was probably someone from out of state working with somebody locally,” Dokweiler said.

Police are still investigating to determine who owns or owned the mobile home, and arrests may be in the offing. “It looks like there’s going to be more connections,” Dokweiler said.
